| Abstract | การเปิดเสรีการบริการขนส่งทางอากาศภายใต้กรอบความร่วมมือทางด้านเศรษฐกิจของอาเซียนก่อให้เกิดการขยายตัวของธุรกิจการบินและความสะดวกสบายที่เพิ่มมากขึ้นแก่ประชาชนในภูมิภาคซึ่งเป็นผลดีต่อด้านเศรษฐกิจและสังคมในภาพรวม แต่ในขณะเดียวกันการปล่อยไอเสียของเครื่องยนต์อากาศยานที่มีปริมาณมากขึ้นก็นำมาซึ่งผลกระทบด้านลบต่อสิ่งแวดล้อมเช่นกัน จากการศึกษาพบว่าความตกลงอาเซียนเกี่ยวกับการเปิดเสรีการขนส่งทางอากาศมิได้มีข้อกำหนดหรือกฎเกณฑ์ใดๆ ที่เป็นมาตรการในเชิงคุ้มครองสิ่งแวดล้อม จึงเป็นการสะท้อนให้เห็นว่าเป็นการดำเนินการที่ไม่สอดคล้องกับหลักการพัฒนาอย่างยั่งยืนที่มีหลักการสำคัญ คือเป็นการพัฒนาที่มีดุลยภาพทั้งด้านเศรษฐกิจ สังคม และสิ่งแวดล้อม ดังนั้น จึงเห็นควรให้มีการนำมาตรการด้านสิ่งแวดล้อมเกี่ยวกับการบินขององค์กรการบินระหว่างประเทศมาเป็นแนวทางในการวางกฎเกณฑ์ร่วมกันของอาเซียนต่อไปThe liberalization of air transport under the ASEAN Economic Community lead to the rapid growth of aviation industry and make international travel throughout the region more convenient. While the policy provides economic and social advantages, it will inevitably produce negative environmental effects due to an increase of aircraft engine emissions. However, the research found that the ASEAN Multilateral Agreement on the Full Liberalization of Air Service does not have any regulations or measures concerning environmental protection. This shows that such ASEAN Agreement is not consistent with sustainable development which reflects a proper balance between the economic, social and environmental dimensions. Accordingly, this essay suggests that the ASEAN should study and critically analyze International Civil Aviation Organization (ICAO) standards and policies related to environmental protection in order to develop ASEAN regulations or policies in the addressed matter. |
