| Abstract | บทคัดย่อบทความวิชาการนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นไปได้ในการพัฒนากฎหมายว่าด้วยอุทยานแห่งชาติของประเทศไทย โดยผู้เขียนเห็นว่า การที่จะพัฒนากฎหมายดังกล่าว เป็นกฎหมายที่ทันสมัย ทัดเทียมกับอารยประเทศนั้น จะต้องมีการปรับเปลี่ยนแนวคิดในพระราชบัญญัติอุทยานแห่งชาติ พ.ศ. 2504 ให้มีความสอดคล้องกับหลักการที่เรียกว่าหลักการพัฒนาอย่างยั่งยืน ในบริบทของกฎหมายสิ่งแวดล้อมภายในเอง หลักการนี้เป็นหลักการที่สำคัญมากที่จะทำให้ คุณค่าที่สำคัญตามหลักการดังกล่าวได้รับการประสานร่วมกัน นั่นคือ คุณค่าทางด้านการพัฒนาและคุณค่าทางด้านสิ่งแวดล้อม ประเทศที่พัฒนาแล้วในหลายประเทศได้นำหลักการนี้ไปบัญญัติไว้ในระบบของกฎหมายสิ่งแวดล้อมและอนุรักษ์ทรัพยากรธรรมชาติของประเทศนั้นๆ อาทิเช่น ประเทศแคนาดา เมื่อได้ศึกษาบทเรียนจากประเทศแคนาดาแล้วเห็นว่า ส่วนที่เกี่ยวข้องกับกฎหมายว่าด้วยอุทยานแห่งชาติของแคนาดา สอดคล้องกับหลักการพัฒนาอย่างยั่งยืน ซึ่งน่าจะนำมาเป็นแนวทางในการแก้ไขกฎหมายว่าด้วยอุทยานแห่งชาติของประเทศไทยต่อไปได้ AbstractThis article aims at analyzing the feasibility of the development of the National Park Act B.E. 2504. In order to modernize the National Park Act B.E. 2504, the essential character of the National Park Act must be changed in conformity with the principle of sustainable development. In the context of national environmental law, the principle of sustainable development is very important in the sense that contested values such as development value and environment value can be harmonized. Many developed nations have implemented the principle of sustainable development into their legal systems. A good example can be derived from Canada. After scrutinizing the Canada National Parks Act 2002, it would not be possible to deny that the essence of the Canada National Parks Act is in conformity with the principle of sustainable development. Indeed, the author has a view that lessons from scrutinizing Canada National Parks Act would be a good guideline for the development of the National Park Act B.E. 2504 in the future. |
