| Abstract | บทคัดย่อมาตรการทางกฎหมาย การบริหารจัดการและนโยบายที่เกี่ยวกับความหลากหลายทางชีวภาพที่สอดคล้องกับหลักการตามอนุสัญญาว่าด้วยความหลากหลายทางชีวภาพอย่างเหมาะสมและมากที่สุดเท่าที่จะเป็นไปได้นั้น ย่อมส่งผลให้เกิดการส่งเสริมการอนุรักษ์และการใช้ทรัพยากรพันธุกรรมพืชอย่างยั่งยืนรวมทั้งส่งเสริมให้เกิดการเข้าถึงและการแบ่งปันผลประโยชน์อันเกิดจากการใช้ทรัพยากรพันธุกรรมอย่างเป็นธรรมและเท่าเทียมกันได้ จากการศึกษาวิจัยพบว่ากฎหมายว่าด้วยการอนุรักษ์และการใช้ทรัพยากรพันธุกรรมพืชของประเทศไทยไม่สอดคล้องกับวัตถุประสงค์และหลักการตามอนุสัญญาว่าด้วยความหลากหลายทางชีวภาพดังนั้น เพื่อให้สอดคล้องกับหลักการดังกล่าว ประเทศไทยควรดำเนินการดังต่อไปนี้ 1) บัญญัติกฎหมายว่าด้วยความหลากหลายทางชีวภาพขึ้นมาเป็นกฎหมายใหม่ที่มีหลักการ แนวทางสอดคล้องกับอนุสัญญาว่าด้วยความหลากหลายทางชีวภาพอย่างเหมาะสมและมากที่สุดเท่าที่จะเป็นไปได้ 2) จัดตั้งองค์กรขึ้นมาใหม่เพื่อบริหารจัดการด้านความหลากหลายทางชีวภาพรวมถึงทรัพยากรพันธุกรรมพืชโดยให้อยู่ภายใต้กฎหมายฉบับนี้AbstractThe legislative, administrative and policy measures regarding biological diversity, which is implemented appropriately and as far as possible in accordance with the principles of the Convention on Biological Diversity, will promote the conservation and sustainable use of plant genetic resources. It will also promote accessing, equitable using and fair benefit sharing of plant genetic resources. The research found that Thai laws regarding the conservation and the sustainable use of plant genetic resources in Thailand still do not fulfill the purposes and the principles of conservation and sustainable use of plant genetic resources provided under the Convention on biological diversity. Therefore, in order to fulfil that purposes, there are two main recommendations for Thailand. Firstly, Enacting the national law on biological diversity, which contains appropriately and as far as possible the principles and guidelines in accordance with the principles of the Convention on Biological diversity. Secondly, a new organization should be established to administer the accessing, benefit sharing and the use of biological diversity including plant genetic resources under the national law. |
