| Abstract | บทคัดย่อ บทความนี้มีวัตถุประสงค์เพื่อศึกษาเปรียบเทียบการได้มาซึ่งสมาชิกวุฒิสภาไทย กัมพูชา และฟิลิปปินส์ เพื่อนำมาปรับปรุงแก้ไขการได้มาซึ่งสมาชิกวุฒิสภาของไทย ผลจากการวิจัยปรากฏว่าสมาชิกวุฒิสภาของไทยมาจากสองทาง ได้แก่ มาจากการเลือกตั้งโดยตรงของประชาชนส่วนหนึ่ง และมาจากการสรรหาของคณะกรรมการสรรหาสมาชิกวุฒิสภาอีกส่วนหนึ่ง ส่วนสมาชิกวุฒิสภาของกัมพูชามาจากสองทางเช่นเดียวกัน กล่าวคือ มาจากการแต่งตั้งของพระมหากษัตริย์กับสมาชิกสภาแห่งชาติส่วนหนึ่ง และมาจากการเลือกตั้งโดยอ้อมของคณะกรรมการชุมชนและแขวงอีกส่วนหนึ่ง สำหรับสมาชิกวุฒิสภาฟิลิปปินส์นั้นมาจากการเลือกตั้งทั่วไปของประชาชนทั้งประเทศ สมาชิกวุฒิสภาของไทยในอดีตมาจากการแต่งตั้งของพระมหากษัตริย์ โดยทรงแต่งตั้งจากผู้ที่มีความรู้ ความสามารถ และมีความซื่อสัตย์สุจริตเป็นที่ตั้ง ส่วนสมาชิกวุฒิสภาที่มาจากการเลือกตั้งของไทยที่ผ่านมา ถูกวิจารณ์จากสังคมว่าได้มาโดยไม่บริสุทธิ์ยุติธรรมเพราะการซื้อสิทธิ์ขายเสียง ผู้วิจัยจึงเห็นว่าประเทศไทยสมควรใช้ระบบการสรรหาสมาชิกวุฒิสภา จากบุคคลที่มีความซื่อสัตย์สุจริตและเชี่ยวชาญจากทุกสาขาอาชีพAbstract This article is aimed at studying the acquisition of senators in Thailand by comparing with the one in Cambodia and the Philippines in order to improve the system in Thailand. The result from this study is that the acquisition of senators in Thailand comes from two ways. One is from the general election and the other from the recruitment of the board of senators, recruitment. In Cambodia, the acquisition of senators also comes from two ways. One is from the appointment of the King and the other from the indirect election of the community and district board. In the Philippines, senators are acquired from the general election of the whole country. In the past, Thai senators were appointed by the King. The latter considered the people who would become senators from their knowledge, competency and honesty. But for the senators who came from the general election, they have been criticized for their buying votes from the people and unfair competition. The researcher hence concludes the Kingdom of Thailand should only apply the system of senators recruitment for the acquisition of senators by choosing the people who are honest, virtuous and have experiences from various occupation. |
