| Abstract | The purposes of this research were to investigate concepts, theory, principles, laws and alternative dispute resolution in Thailand and abroad. To present the appropriate alternative dispute resolution in environmental case in Thailand. According to studies, it has been found that negotiations are inappropriate and it is difficult to apply to environmental cases in Thailand. Mediation of disputes has more advantages than disadvantages. Therefore suitable to be used for environmental dispute resolution in Thailand But it is difficult because it is still limited. Arbitration has more advantages than disadvantages. Therefore, it is appropriate and possible to apply to environmental cases in Thailand. But there are some limitations in the implementation. The process of mediation of France has limited scope of use. Therefore not suitable to be used for environmental cases in Thailand. German mediation process may not be able to help the disputing parties in finding a solution together to solve the environmental case problem in accordance with the dispute therefore, it is not appropriate to apply the German environmental dispute resolution method to Thailand. Japan has four options for the use of alternative dispute resolution for the environmental cases. These include; the conciliation; the mediation; the arbitration; and the judicial procedures. Therefore, it is highly appropriate to apply the Japanese environmental dispute resolution method to Thailand. |
