| Abstract | การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นมา แนวคิดพื้นฐานหลักการและทฤษฎีทางกฎหมายมหาชนที่เกี่ยวข้องกับมาตรการบังคับทางปกครอง ศึกษากฎหมายที่เกี่ยวข้องกับมาตรการบังคับทางปกครองทั้งในประเทศและต่างประเทศ ศึกษาสภาพปัญหาของการใช้มาตรการบังคับทางปกครองตามพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ.2539 วิเคราะห์สภาพปัญหาของการใช้มาตรการบังคับทางปกครองตามพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ.2539 และศึกษาและเสนอแนะแนวทางการแก้ไขการใช้มาตรการบังคับทางปกครองตามพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ. 2539 ที่เหมาะสมกับประเทศไทย การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพโดยการวิจัยเอกสารจากบทบัญญัติของรัฐธรรมนูญ บทบัญญัติแห่งกฎหมาย กฎ ระเบียบ หนังสือ ตำรา บทความทางวิชาการ งานวิจัย ตลอดจนคำพิพากษาและคำสั่งศาลปกครองที่เกี่ยวข้อง อีกทั้งศึกษากฎหมายต่างประเทศเกี่ยวกับวิธีปฏิบัติราชการทางปกครองเพื่อนำมาวิเคราะห์เปรียบเทียบกับกฎหมายไทย ผลการศึกษาพบว่า ถ้าประเทศไทย แก้ไขพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ.2439 ให้มีมาตรการบังคับทางปกครองเป็นการเฉพาะ โดยไม่นำประมวลกฎหมายวิธีพิจารณาความแพ่งมาใช้บังคับ จะทําให้การบังคับทางปกครองในการยึดและอายัดทรัพย์สินมีประสิทธิภาพยิ่งขึ้น ถ้าประเทศไทย แก้ไขกฎกระทรวงฉบับที่ 9 (พ.ศ. 2542) ให้เจ้าหน้าที่ผู้ออกสั่งทางปกครองสามารถออกคําสั่งบังคับทางปกครองในการยึด อายัดทรัพย์สิน หรือสั่งให้ชำระเงินได้เอง จะทำให้การบังคับทางปกครองมีประสิทธิภาพมากยิ่งขึ้น และถ้าประเทศไทยแก้ไขพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง ให้เจ้าหน้าที่ผู้ออกคำสั่งทางปกครองที่ให้ชำระเงินสามารถกำหนดจํานวนค่าปรับได้สูงเพื่อให้สอดคล้องกับสภาพเศรษฐกิจในปัจจุบันจะทำให้การบังคับทางปกครองมีประสิทธิภาพมากยิ่งขึ้น || The objectives of this independent study are to study the history, the basicconcepts, principles and theories of public law relating to the administrative measures, the laws relating to the administrative measures both nationally and internationally, the problem of using administrative measures according to the Administrative Procedure Act B.E. 2539; to analyze the problem of using administrative measures according to the Administrative Procedure Act B.E. 2539; and to recommend solutions to the use of administrative measures appropriate to Thailand. This independent study is qualitative research using documentary research method. The data were collected from the provisions of the Constitution, provisions of the law, rules, regulation, books, textbooks, academic articles, researches, judgments and related court orders, and the study of international law on administrative proceduresto be analyzed and compared with the law of Thailand. The results showed that amendments of the Administrative Measures Practices Act B.E. 2439 to enforce the administrative measures specifically without applying the Code of Civil Procedure could make the administrative enforcement in seizing and seize assets more effectiveness, amendment of the Ministerial RegulationNo. 9 (B.E. 2542) for the officers who issue the administrative order can issue the administrative order in seizing and detained property or ordered to pay oneself, could make the enforcement of administrative measures more effectiveness, and amendments of the Act on administrative procedures for the officers who issued the administrative order for the payment of fines could lead to higher amount of fines suitable to the current economic conditions, and the more efficient administrative enforcement. |
