| Abstract | บทคัดย่อ การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษา 1. สภาพปัญหาการบริหารการถูกฟ้องคดีปกครองของหน่วยงานการศึกษา 2. ปัจจัยการบริหารที่ส่งผลต่อการป้องกันถูกฟ้องคดีปกครองของหน่วยงานการศึกษา 3. ประสิทธิผลการบริหารการป้องกันถูกฟ้องคดีปกครองของหน่วยงานการศึกษา 4. เสนอรูปแบบการป้องกันถูกฟ้องคดีปกครองที่มีประสิทธิผลของหน่วยงานการศึกษากลุ่มตัวอย่างที่ใช้ในการวิจัย คือ ผู้บริหาร ครู ผู้อำนวยการสำนักงานเขตพื้นที่การศึกษา บุคลากรทางการศึกษา ในสำนักงานเขตพื้นการศึกษาประถมศึกษาเพชรบูรณ์ เขต 1, 2, 3 และสำนักงานเขตพื้นที่การศึกษาประถมศึกษาพิจิตร เขต 1, 2 จำนวน 370 คน เครื่องมือในการเก็บรวบรวมข้อมูลคือ แบบสอบถามและแบบสัมภาษณ์ เครื่องมือในการวิเคราะห์ข้อมูล คือ สถิติเชิงพรรณนา ใช้แจกแจงความถี่ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน ใช้สถิติเชิงอ้างอิง (Inferential statistics) เป็นวิธีการทางสถิติที่วิเคราะห์ข้อมูลจากกลุ่มตัวอย่าง ได้แก่ การวิเคราะห์ความแปรปรวนทางเดียว (ne-way analysis of variance) การวิเคราะห์ถดถอยพหุคูณ (Multiple Regression Analysis) การวิจัยเชิงคุณภาพเป็นงานศึกษาวิจัยเชิงผสมผสาน (Mixed method research) พื้นที่การวิจัยเชิงคุณภาพในการศึกษาวิจัยครั้งนี้ใช้เขตพื้นที่ของสถานศึกษาและในสำนักงานเขตพื้นที่การศึกษาประถมศึกษา จำนวน 5 แห่ง ของจังหวัดเพชรบูรณ์และจังหวัดพิจิตร จำนวน 19 คนเก็บข้อมูลด้วยวิธีการสัมภาษณ์เจาะลึก (In-Depth Interview) นำข้อมูลเชิงปริมาณและคุณภาพมาผสมผสานแบบสามเส้า (triangulation design) ข้อมูลที่ได้นำมาเปรียบเทียบสรุปตีความว่าส่วนใดเหมือนกัน สอดคล้องกัน คล้ายกันและส่วนใดแตกต่างกันนำมาอธิบายร่วมกันผลการวิจัย พบว่า สภาพปัญหาหน่วยงานการศึกษาถูกฟ้องคดีปกครองไม่ปฏิบัติตามระเบียบกฎหมายปกครอง ละเลยล่าช้า กระทำละเมิด ปัจจัยที่ส่งผลต่อการป้องกันของหน่วยงานในการออกกฎ คำสั่งทางปกครองต้องตรวจสอบอำนาจหน้าที่ทางปกครอง ตรวจสอบการใช้กฎหมาย และประสิทธิผลการบริการในการป้องกันต้องให้ความสำคัญในการย้ายโอนเปลี่ยนตำแหน่ง การสรรหาบรรจุแต่งตั้ง การเลื่อนขั้นเงินเดือนวิทยฐานะ คำสำคัญ : ประสิทธิผลการบริหาร การป้องกันถูกฟ้องคดีปกครอง หน่วยงานการศึกษา Abstract This research aims to study : 1. Litigation management issues governing the education Agency; 2 . Factors that affect the management of the defense of the litigation department of education; 3 . Effective administrative litigation department of defense education agency; and 4. Offer a defense litigation ruled that the effectiveness of the education agency . The samples used in this study was the executive director of the Office of Teacher Education .Educational District Office of Education in the Bangkok Area 1, 2 , 3, and Office of Elementary Phichit Zones 1 , 2 and 370 people the tools to collect data. Questionnaires and interviews Tools for data analysis The descriptive statistics Using frequency distribution , mean , standard deviation. According to statistics (Inferential statistics) as a method of statistical analysis of data from a one-way analysis of variance multiple regression analysis (Multiple Regression Analysis). Qualitative Research The studies were combined (Mixed method research) areas of qualitative research . In this study the area of Education and the Office of Elementary 5 of the Phetchabun Province Phichit were 19 other people with the interview (In-Depth Interview) The quantitative data . and quality triangulation mix (triangulation design) data can be compared to the same conclusion that any consistent interpretation similar and different parts are described together.The results showed that the state education agency problems litigant parents do not comply neglect delay violated laws governing factors affecting the protection of the authorities to rule out. Administrative order to check the administrative authority. Check the laws And effectiveness of prevention services need to focus on migration change.
