บทคัดย่อ

เกษตรพันธะสัญญาตามทฤษฎีถูกนำมาใช้เพื่อรักษาระดับการส่งออกและระดับราคาของสินค้า แต่ในทางปฏิบัติพบว่าการทำเกษตรพันธะสัญญาเป็นสัญญาที่ถูกกำหนดโดยแต่ฝ่ายเดียว ซึ่งมีอำนาจต่อรองเหนือกว่า ทำให้เกษตรกรไม่ได้รับความเป็นธรรมจากสัญญา ก่อให้เกิดปัญหาเกษตรกรมีหนี้สินจากการทำเกษตรกรรม และรายได้ไม่คุ้มค่ากับค่าใช้จ่ายที่ต้องเสียไป เมื่อมีการจัดตั้งประชาคมเศรษฐกิจอาเซียนทำให้ปลอดภาษีนำเข้า ย่อมส่งผลให้มีการนำเข้าสินค้าเกษตรกรรมประเภทเดียวกับสินค้าเกษตรของประเทศไทย ซึ่งกฎหมายของประเทศไทยที่มีอยู่ในปัจจุบันก็มีมาตรการไม่เพียงพอที่จะคุ้มครองเกษตรกรให้ได้รับความเป็นธรรม เมื่อสินค้าประเภทเดียวกันเข้ามาในประเทศไทย

จากปัญหาดังกล่าวพบว่า ควรมีกฎหมายเพื่อคุ้มครองการทำเกษตรพันธะสัญญาโดยเฉพาะ และกำหนดแบบของสัญญามาตรฐานของประเทศไทยและกฎหมายแม่แบบของประชาคมเศรษฐกิจอาเซียนที่คู่สัญญาต้องปฏิบัติตาม ควรมีหน่วยงานที่ใช้อำนาจปกครองในการใช้อำนาจควบคุมให้เป็นไปตามกฎหมาย เพื่อให้เกิดความเป็นธรรมต่อคู่สัญญา เมื่อมีสัญญาที่เป็นธรรมแล้วจึงนำสัญญาดังกล่าวมาใช้ส่งเสริมการส่งออกสินค้าเกษตร เพื่อให้สามารถจำหน่ายผลผลิตทางการเกษตรออกไปยังประเทศที่ไม่สามารถผลิตสินค้าเกษตรได้ และส่งเสริมให้นักลงทุนของประเทศไทยนำเกษตรพันธะสัญญาไปลงทุนยังประเทศอื่นในประชาคมเศรษฐกิจอาเซียน ซึ่งสินค้าเกษตรบางประเภทไม่สามารถผลิตได้ในประเทศไทย หรือผลิตได้แต่ไม่เพียงพอใช้ในประเทศ ไม่ต้องซื้อผลผลิตทางการเกษตรที่ราคาแพงตามราคาตลาดโลก และส่งเสริมให้คนไทยประกอบธุรกิจบริการจัดหาคู่ค้าในการทำเกษตรพันธะสัญญา

Abstract

In theory, contract farming can help maintain the volume of export and the price level of agricultarel products. However, in practice, it is found that the contract farming is the contract prepared by the only company. It possesses the superiority of bargaining power over farmers. This makes farmers in the unfair situation and also leads them to be in debt from farming because the farmer's income does not cover the expense. The establishment of ASEAN Economic Community will enhance free-taxed import and also affect the same type of Thai agricultural products. Currently, legal measure stipulated in Thai law is not effective enough to protect farmers to receive fair prices from the similar products imported into Thailand.

From the aforementioned problem, it is found that there should be a special law to protect the contract farming. In addition, the pattern of standard form of contract should be uniformed and standardized in Thailand and make the model law for all parties in ASEAN Economic Community to follow. Moreover, there should be the authorized office to inspect and control in accordance with the law for the fairness of all related contract parties. The justified contract can enhance the export in agricultural products. Foreign investors who are interested in investing with Thai farmers have to follows the model of contract farming. This can promote the distribution of agricultural products in other countries and encourage Thai investors to invest in other countries in ASEAN Economic Community. There are some products that cannot be produced in Thailand or are not sufficient for domestic use. The contract farming can help Thai manufacturers to buy agricultural products with fair prices in line with the World market prices. Additionally, it also encourages Thai people to do service business in arranging counterparts in the contract farming.
