บทคัดย่อ

การวิจัยเรื่อง “ความรู้และการใช้ความรู้ด้านกฎหมายและจริยธรรมสื่อมวลชนของนักหนังสือพิมพ์ท้องถิ่นจังหวัดลำปาง” นี้ ได้รับทุนสนับสนุนจากมหาวิทยาลัยราชภัฏลำปาง มีวัตถุประสงค์เพื่อสำรวจความรู้ความเข้าใจเกี่ยวกับกฎหมายและจริยธรรมสื่อสารมวลชนของนักหนังสือพิมพ์ท้องถิ่นจังหวัดลำปาง เสริมสร้างความรู้ความเข้าใจเกี่ยวกับประเด็นดังกล่าว และจัดทำคู่มือแนวทางการใช้ความรู้ด้านกฎหมายและจริยธรรมสื่อมวลชน

ผลการวิจัยพบว่ากลุ่มตัวอย่างนักหนังสือพิมพ์ท้องถิ่น บางส่วนประสบกับปัญหาเกี่ยวกับกฎหมายที่เกี่ยวข้อง สรุปประเด็นปัญหาสำคัญ คือ (1) กลุ่มตัวอย่างเห็นว่าหนังสือพิมพ์มักไม่ได้รับสิทธิตามที่รัฐธรรมนูญรับรองไว้ ซึ่งจะสัมพันธ์กับสิทธิในการรับรู้ข้อมูลข่าวสารของทางราชการ เมื่อไปขอเอกสารต่าง ๆ มักถูกอ้างว่าเป็นความลับของทางราชการ ดังนั้น รัฐมักอ้างกฎหมายในการปิดบังไม่ให้ข้อมูลกับสื่อ (2) พระราชบัญญัติจดแจ้งการพิมพ์ กลุ่มตัวอย่างเห็นว่าไม่มีปัญหาในการจดแจ้งการพิมพ์ ปัจจุบันการจดแจ้งการพิมพ์กระทำได้ง่าย แต่ในอีกแง่มุมหนึ่ง อาจทำให้หนังสือพิมพ์กลายเป็นเครื่องมือของกลุ่มต่าง ๆ เนื่องจากไม่ได้มีการสอบประวัติเช่นในอดีตที่ต้องขออนุญาตจดทะเบียนกับสันติบาล (3) พระราชบัญญัติข้อมูลข่าวสารของทางราชการ กลุ่มตัวอย่างเห็นว่าตนมีปัญหาเกี่ยวกับการรับรู้ข้อมูลข่าวสารในเรื่องที่เกี่ยวกับความมั่นคงของรัฐ (4) กฎหมายหมิ่นประมาท กลุ่มตัวอย่างเห็นว่าหนังสือพิมพ์ยิ่งพูดความจริงมากเท่าใดก็จะถูกฟ้องมากเท่านั้น ต้องไปแก้ต่างในศาล ส่วนในกรณีที่หนังสือพิมพ์ลงข่าวผิดพลาด ก็มีการประนีประนอมกันโดยลงข่าวแก้ไขให้

ผลจากการศึกษาได้นำมาจัดทำเป็น “คู่มือกฎหมายและจริยธรรมหนังสือพิมพ์” โดยสรุปประเด็นที่สำคัญที่ได้จากกระบวนการเรียนรู้ร่วมกันระหว่าง ผู้วิจัย อาจารย์ด้านนิเทศศาสตร์ อาจารย์ด้านนิติศาสตร์ นักศึกษาสาขาวิชานิเทศศาสตร์ และตัวแทนหนังสือพิมพ์ท้องถิ่นที่ให้ข้อมูลโดยการสัมภาษณ์และร่วมเสวนา

Abstract

The research on knowledge and knowledge uses of media law and ethics of Lampang local journalists was funded by Lampang Rajabhat University. It aimed to explore the knowledge and knowledge uses of media law and ethics of Lampang local journalists in order to enhance the knowledge of Lampang local journalists regarding such spheres and to produce a media law and ethics handbook. The research found that some of the samples encountered problems related to media laws as the followings: (1) The samples considered that the press frequently did not obtain the right stipulated in the constitution which was associated to the right to know official information in the case that they were frequently refused by the state officials when applying to access information for the reason that it was information falling under the official secret. Thus, the state often claimed the law in order not to expose information to the media. (2) The samples considered that they did not have trouble with registration of newspaper. The newspaper registration was uncomplicated. However, that might cause the newspaper to be exploited by some kinds of the interest group for there was no personal record check as it was done in the past when the newspaper registration had to be granted by the public security police. (3) The samples viewed that they had trouble with the Official Information Act regarding the state security information disclosure. (4) The samples were troubled with defamation law. They thought that the more they told the truth, the more chances they were sued. But in the case of incorrect information, they could compromise by correcting the mistake.

The findings were used to produce the media law and ethics handbook by summarizing the important matters resulted from the knowledge sharing among the researcher, Communication Arts lecturers, Law lecturers, the Communication Arts students who enrolled in the Media Law and Ethics course, and the local journalists who were interviewed and attended the knowledge exchange meeting.
