| Abstract | การฟื้นฟูเมืองแบบพัฒนาขึ้นใหม่ (Urban Redevelopment) คือ การฟื้นฟูเมืองในบริเวณพื้นที่ที่สภาพทางเศรษฐกิจ สังคม และสภาพแวดล้อมยากเกินกว่าจะแก้ไขปรับปรุง จึงจำเป็นที่จะต้องรื้อถอนอาคารและโครงสร้างพื้นฐานที่มีอยู่เดิมแล้วก่อสร้างขึ้นมาใหม่เพื่อตอบรับวัตถุประสงค์ของการฟื้นฟูพื้นที่นั้นๆ ปัจจุบันกฎหมายที่เกี่ยวข้องกับการฟื้นฟูเมือง ได้แก่ พระราชบัญญัติการผังเมือง พ.ศ.2562 พระราชบัญญัติควบคุมอาคาร พ.ศ. 2522 พระราชบัญญัติจัดรูปที่ดินเพื่อพัฒนาพื้นที่ พ.ศ. 2547 พระราชบัญญัติการเคหะแห่งชาติ พ.ศ. 2537 และพระราชบัญญัติว่าด้วยการเวนคืนและการได้มาซึ่งอสังหาริมทรัพย์ พ.ศ. 2562 เป็นเครื่องมือสำคัญของการนำที่ดินมาพัฒนาขึ้นใหม่ อย่างไรก็ตามกฎหมายที่กล่าวมาทั้งหมดข้างต้นยังมีปัญหาไม่สอดคล้องและไม่สนับสนุนรูปแบบการฟื้นฟูเมืองแบบพัฒนาขึ้นใหม่ (Urban Redevelopment) ในหลายประการ ทั้งนี้ ผู้เขียนเห็นว่ามีปัญหาสำคัญ 3 ประการที่ควรจะศึกษา ประการแรก เรื่องการอ้างประโยชน์สาธารณะกับการฟื้นฟูเมืองแบบพัฒนาขึ้นใหม่ ประการที่สอง การขาดเครื่องมือทางกฎหมายเพื่อฟื้นฟูเมืองแบบพัฒนาขึ้นใหม่ ประการสุดท้าย การขาดเครื่องมือทางการเงินในการสนับสนุนการดำเนินงาน ดังนั้น เพื่อแก้ปัญหาที่กล่าวมาข้างต้นผู้เขียนเห็นว่าควรมีบทบัญญัติเรื่องการฟื้นฟูเมืองแบบพัฒนาขึ้นใหม่เป็นการเฉพาะขึ้นใหม่ เพื่อการฟื้นฟูเมืองที่มีความเหมาะสมและมีประสิทธิภาพสำหรับประเทศไทยต่อไปUrban Redevelopment is a reconstruction of an urban area whose environmental, social and economic conditions have become too degraded to improve, and must therefore be demolished and reconstructed in order to satisfy the goals of the urban revitalization program. At the moment, legislations pertaining to urban development in Thailand are: Town Planning Act B.E. 2562, Building Control Act of B.E. 2522, Land Readjustment Act of B.E. 2547, National Housing Authority Act B.E. 2537 and Expropriation and Acquisition of Immovable Property Act B.E. 2562. However, all of the above laws still do not correspond to many aspects of the urban redevelopment. In this regard, the author considers that there are three important problems that should be studied. First, Public interest and Urban Redevelopment. Second, the lack of legal tools to support Urban Redevelopment. Third, the lack of financial tools to support operations. The author suggests that a new legislation dealing specifically with the urban redevelopment should be enacted for suitable and effective urban redevelopment in Thailand. |
