| Abstract | กฎหมายที่เกี่ยวกับการปกป้องคุ้มครองศพตั้งแต่กฎหมายตราสามดวง จนถึงประมวลกฎหมายอาญา อย่างไรก็ตามเมื่อได้มีการบัญญัติพระราชบัญญัติแก้ไขเพิ่มเติม ประมวลกฎหมายอาญา (ฉบับที่ 27) พ.ศ. 2562 ได้มีสาระสำคัญของกฎหมายที่บัญญัติขึ้นใหม่ เป็นเรื่องแก้ไขเพิ่มเติมเกี่ยวกับการกระทำชำเราศพ การกระทำให้ศพเสียหาย และการดูหมิ่นเหยียดหยามศพ กฎหมายดังกล่าวมีปัญหาสำคัญในการบัญญัติโทษของการกระทำผิดเกี่ยวกับศพที่ได้มีการบัญญัติโทษที่ค่อนข้างสูง โดยไม่ได้พิจารณาให้สอดคล้องกับความผิดอาญาลักษณะอื่นๆ โดยมีข้อสังเกตว่าได้มีการคุ้มครองศพมากกว่าการคุ้มครองบุคคลที่ยังมีชีวิตอยู่ ดังนั้น เพื่อแก้ปัญหาความไม่เป็นธรรมในเรื่องโทษข้างต้น ผู้เขียนเสนอแนะว่าควรบัญญัติกฎหมายในเรื่องดังกล่าวให้เป็นความผิดลหุโทษ ซึ่งจะก่อให้เกิดความเป็นธรรมแก่ผู้กระทำความผิด และผู้เสียหายด้วยThe purpose of this article is to study the evolution of criminal liability of "Corpses" in Thailand.It aims to explain the evolution of laws relating to the corpses protection in Thai laws from the Three Seals Law to the present Thailand Penal Code. However, after having enacted Thailand Penal Code Amendment Act (No. 27) B.E. 2562 the essence of the laws is amended on the act of rape, mischief and defame corpses. The problem of the legislation for corpse-related offenses is the unproportioned criminal penalty punishment compared with other criminal offenses. It is note that the level of criminal liability gave protection to the corpses is higher than the protection of the living person. The authors suggest that a new legislation should be enacted for the offence to be Minor offence which will cause justice for offender and the victim as fair. |
