| Abstract | ปัจจุบันหลายประเทศมีการนำสารเบนซีน (Benzene) อันเป็นสารก่อมะเร็งมาใช้ในการประกอบกิจการอุตสาหกรรม หากมีการรั่วไหลและแพร่กระจายของสารเบนซีนจากการใช้อาจก่อให้เกิดผลกระทบต่อสุขภาพอนามัยของลูกจ้าง ประชาชน และสิ่งแวดล้อม ซึ่งต้องเยียวยาความเสียหายให้แก่ลูกจ้าง ประชาชน และรัฐ ดังนั้นประเทศอุตสาหกรรมชั้นนำ อาทิเช่น ประเทศสหรัฐอเมริกามีการตรากฎหมายเพื่อเยียวยาความเสียหายให้แก่ลูกจ้าง ประชาชน และรัฐจากการใช้สารเบนซีนในโรงงานอุตสาหกรรม แม้ว่าการเยียวยาความเสียหายตามกฎหมายของประเทศไทยให้แก่ลูกจ้าง ประชาชน และรัฐ มีความทัดเทียมกับกฎหมายของประเทศสหรัฐอเมริกาก็ตาม แต่กฎหมายของประเทศไทยสามารถปรับปรุงให้เป็นไปตามกฎหมายของประเทศสหรัฐอเมริกา ในเรื่องการเยียวยาความเสียหายจากการใช้สารเบนซีนในโรงงานอุตสาหกรรมให้แก่ลูกจ้าง ประชาชน และรัฐให้ดีขึ้นกว่าระดับในปัจจุบันได้ คือกฎหมายของประเทศไทย ลูกจ้างมีสิทธิได้รับเงินทดแทนต่อเมื่อเจ็บป่วยด้วยโรคจากสารเบนซีนเนื่องจากการทำงานแล้วเท่านั้น ผู้เขียนเห็นว่ากฎหมายของประเทศไทยควรมีการกำหนดให้ลูกจ้างมีสิทธิได้รับเงินทดแทนได้ต่อเมื่อมีโอกาสมากกว่าร้อยละห้าสิบที่จะเจ็บป่วยด้วยโรคที่เกิดขึ้นจากการทำงาน อันเป็นประโยชน์แก่ลูกจ้างมากกว่า กฎหมายของประเทศไทยไม่มีข้อยกเว้นการจ่ายเงินทดแทนกรณีลูกจ้างจงใจฝ่าฝืนกฎเกณฑ์เกี่ยวกับความปลอดภัย ผู้เขียนเห็นว่ากฎหมายของประเทศไทยควรเพิ่มข้อยกเว้นการจ่ายเงินทดแทนกรณีลูกจ้างจงใจฝ่าฝืนกฎเกณฑ์เกี่ยวกับความปลอดภัย อันจะเป็นการป้องกันมิให้ลูกจ้างเจ็บป่วยด้วยโรคที่เกิดขึ้นจากการทำงาน และกฎหมายของประเทศไทยไม่มีบทบัญญัติเรื่องค่าเสียหายเพื่อการลงโทษ ผู้เขียนเห็นว่ากฎหมายของประเทศไทยควรมีบทบัญญัติเรื่องค่าเสียหายเพื่อการลงโทษ อันเป็นการป้องกันมิให้ผู้กระทำความผิดกระทำความผิดซ้ำAt present, many countries have used benzene as a carcinogen for industrial operations. If there is a leak and spread of benzene, it may affect the health of the employees, public and the environment, the industrial operators must compensate the damage to the employees, public and state. Therefore, the leading industrial countries such as the United States have enacted laws to compensate the damages to the employees, public and state from the use of benzene in industries. Although the compensation of benzene's usage in Thailand is comparable to the USA's law, but it can also improve according to the USA's law, the compensations for the employees, public and state to be better than the current level. The law of Thailand, employees are entitled to compensation only disease which caused from benzene usages in work. The author suggests the law of Thailand should be determined the employees shall be entitled to compensation when the risk is more than fifty-five percent to get disease, that is more beneficial to employees. Thailand do not have an exemption to pay compensation if the employees are willfully misconducting the safety regulations. The author also suggests the law of Thailand should be added to the exemption of compensation for the employees intentionally misconducting the safety regulations that will prevent the employees from a disease proximately caused by the employment. And the law of Thailand, there are no provisions for punitive damages, so the author suggests the law of Thailand should have punitive damages which prevent repeat offences. |
