| Abstract | บทความนี้ มีวัตถุประสงค์เพื่อกำหนดรูปแบบและแนวทางที่เหมาะสมในการพัฒนาเครื่องมือการวิเคราะห์ผลกระทบในการออกกฎหมาย หรือ Regulatory Impact Assessment (RIA) ซึ่งจะทำาให้เกิดความก้าวหน้าในการปฏิรูปกฎหมายของประเทศและจัดทำกฎหมายให้มีคุณภาพยิ่งขึ้น ปัจจุบันยังพบปัญหาและอุปสรรคในการวิเคราะห์ผลกระทบในการออกกฎหมาย สาเหตุมาจากหลักเกณฑ์และกระบวนการในการวิเคราะห์ที่ไม่เหมาะสมและไม่ชัดเจนเพียงพอสำหรับการนำไปปฏิบัติ ดังนั้น ผู้วิจัยจึงเห็นควรปรับปรุงหลักเกณฑ์และกระบวนการในการวิเคราะห์ผลกระทบในการออกกฎหมายของไทยให้ทัดเทียมกับนานาอารยประเทศ และสอดคล้องกับบริบทของประเทศไทยThis article is aimed at proposing a suitable model and guidance for developing regulatory impact assessment (RIA) in Thailand. The RIA will help advancing the country's regulatory reform and thereby improving its law-making process. At present, there are problems and obstacles in Thailand's RIA due to the lack of clear and appropriate procedure and criteria for assessing the impact of regulation which causes implementation problems. Therefore, the researchers suggest Thailand should improve its RIA procedure and criteria in order to level with those of other countries and also suit its context. |
