| Abstract | บทคัดย่อจากการที่รัฐธรรมนูญมีหลักการที่รับรองให้ชุมชนและประชาชนมีสิทธิในการมีส่วนร่วมอนุรักษ์และใช้ประโยชน์จากทรัพยากรธรรมชาตริ วมถงึ ทรพั ยากรประมง แต่ในการดำเนินมาตรการดังกล่าว พบว่ายังมีข้อจำกัดทางกฎหมายหลายประการ อาทิ การกระจายอำนาจสู่ท้องถิ่นยังไม่สมบูรณ์ เกิดช่องว่างของการใช้อำนาจในระหว่างองค์กรผู้ใช้อำนาจเดิมกับองค์กรท้องถิ่นผู้รับโอนอำนาจ การใช้สิทธิมีส่วนร่วมของชุมชนและประชาชน ยังไม่มี กฎหมายที่กำหนดรายละเอียด และ/หรือวิธีการใช้สิทธิในการมีส่วนร่วมดังกล่าว ประกอบกับการทำประมงที่เกินขนาด และการแย่งชิงทรัพยากรประมงระหว่างประมงชายฝั่งกับประมงพาณิชย์จึงควรบัญญัติกฎหมายรองรับการมีส่วนร่วมของชุมชนและประชาชนในการจัดการทรัพยากรประมงในท้องถิ่น รวมทั้งมาตรการจัดการทรัพยากรประมงให้คงไว้สำหรับการใช้ประโยชน์ได้อย่างยั่งยืนAbstractThe Constitution affirms the rights of community and people to participate in conservation and the use of natural resources and environment, including, fisheries resources. However, there are some problems on implementing the said measures such as the inefficiency of decentralization to local areas, the gap of the power between competent authority and local authority, how to exercise the right of community and people to participate in management, maintenance, and the use of natural resources. Unfortunately, there is no law which specifies details, conditions or methods to implement the rights to participate in the management of such resources and over fishing which lead to the conflict between small scale fishing and commercial fishing. Therefore, the law should be legislated to manage the said fisheries and empower community and people to participate in the management of fisheries resources in local areas for a sustainable use |
