Abstract Thailandtransitioningto AEC causedvarious changes toThai society, suchas social,economicandlegal. Ineachcategory, labour law, whichaims toprohibit conflictsandpromoterelationshipbetween employees and employers, including establishing organization for employees andemployers with the main objective being to create peace in labour society. The main focuson this research was to study labour movement in Thailand after the transitioning to AEC asdemanded by communication, industrialization and production sectors supported by domesticlabour shortage situation. Therefore, once the labour migrating among nations begins, it creates diversity in workplacesespecially thebusinesses intheborderlineareas connectedtotheneighboringcountries.Current rules and regulation may be considered inhibiting or obstructing freedom to expressionand assembly in which causesThailand to be perceived by the international labour society as acountry with no such rights.The perception could result in trade protectionism and discouragingforeign investment; moreover, one of the reasons to amend the current laws is as Thailand isone of the founding members of International Labor Organization (ILO) but has failed to complywith the main principle to promote freedom in establishing labor unions under the ILO. According to Thailand laws especially the Labour Relations Acts B.E. 2518 presentedno revision in order to meet with occurred changes in the current context; for example, theboard of employees or labour union which was legally protected only Thai national while themovement of labour caused by the AEC transition may affiliate more than one nationality in anenterprise. Limitation only to Thai nationality as a representative for the employees; therefore,may be inefficiently facilitate fairness and justice in labour society. Adopting EU as a model in merging into AEC in terms of legislation, regulationsand organization establishment, this research presents background, history, elements andpreparation of the EU before labour movement occurs including other relevant aspects.
