| Abstract | ความผิดเกี่ยวกับเพศในประมวลกฎหมายอาญานั้น ได้ถูกแก้ไขเพิ่มเติมมาแล้วด้วยกันหลายครั้ง ซึ่งการแก้ไขเพิ่มเติมในแต่ละครั้งนั้น นอกจากเพื่อความสมบูรณ์ของตัวบทกฎหมาย หรือเพื่อการใช้การตีความแล้ว ยังขึ้นอยู่กับบริบทของสังคม ตลอดจนการเปลี่ยนแปลงของแนวความคิด ค่านิยาม และบรรทัดฐานทางสังคมอีกด้วย ทั้งนี้ เพื่อให้ประมวลกฎหมายอาญามีความทันสมัย และสามารถใช้บังคับได้เสมอในการแก้ไขเพิ่มเติมครั้งล่าสุดนั้น คือ ครั้งที่ 27 มีการแก้ไขเพิ่มเติมทั้งคำนิยามของการกระทำชำเรา ตลอดจนแก้ไขเพิ่มเติมในส่วนที่กระทบหรือเปลี่ยนแปลงองค์ประกอบความผิดอาญาในความผิดฐานนี้บทความนี้จึงมุ่งศึกษาความผิดฐานข่มขืนกระทำชำเราและรวบรวมปัญหาที่เกิดขึ้น จากการใช้การตีความตัวบท แนวคำพิพากษาศาลฎีกาที่เกี่ยวข้อง ตลอดจนข้อสังเกตในประเด็นปัญหาเรื่องการใช้การตีความกฎหมายฐานดังกล่าวProvisions pertaining to sexual offences under Thai Penal Code has often been amended. Apart from benefits of legal fulfillment and construction, the amendment was made in line with currently social contexts (e.g., changes in belief, values, and social institutions). Such amendment is aimed to keep the statute updated and enforceable. Obviously, the recent amendment in relation thereto (27th Amendment), thereby definition of 'raping' was successfully reconsidered. This also covers element of (sex)crime.This paper is designed to scrutinize the rape crime, and collect relevant and problematic facts concerning the crime, court's ruling. The paper also raises awareness of legal interpretation governing the crime. |
