| Abstract | ในปัจจุบันการผลิตไฟฟ้าจากพลังงานลมเป็นกิจกรรมหนึ่งที่รัฐบาลในหลายประเทศสนับสนุนให้ใช้แทนการผลิตไฟฟ้าจากพลังงานถ่านหินและเชื้อเพลิง เนื่องจากเป็นแหล่งพลังงานที่ไม่เพิ่มคาร์บอนไดออกไซด์ในอากาศ อย่างไรก็ตาม แม้ว่าการผลิตไฟฟ้าจากพลังงานลมจะช่วยลดการเกิดก๊าซเรือนกระจกในอากาศ โครงการผลิตไฟฟ้าจากพลังงานลมก็อาจส่งผลกระทบต่อสิ่งแวดล้อมและชุมชนได้ เช่น ผลกระทบจากเสียง และสารเคมี เป็นต้น ดังนั้น เพื่อป้องกันผลกระทบที่อาจเกิดจากโครงการผลิตไฟฟ้าจากพลังงานลม การประเมินผลกระทบสิ่งแวดล้อมจึงควรนำมาใช้ก่อนการดำเนินกิจกรรมดังกล่าว ทั้งนี้ จากการศึกษากฎหมายที่เกี่ยวกับการประเมินผลกระทบสิ่งแวดล้อมในประเทศไทยแล้ว พบว่า โครงการผลิตไฟฟ้าจากพลังงานลมไม่เข้าหลักเกณฑ์ที่ต้องจัดทำรายงานการประเมินผลกระทบสิ่งแวดล้อมตามพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 แต่ต้องจัดทำรายงานการประเมินผลกระทบสิ่งแวดล้อมตามกฎหมายฉบับอื่น ซึ่งแตกต่างจากกฎหมายสกอตแลนด์ที่กหนดให้โครงการผลิตไฟฟ้าจากพลังงานลมตามเงื่อนไขที่กฎหมายกำหนด ต้องมีการจัดทำรายงาน การประเมินผลกระทบสิ่งแวดล้อมก่อนการดำเนินการ และยังมีรูปแบบการประเมินผลกระทบสิ่งแวดล้อมอื่นตามกฎหมายที่น่าสนใจ เช่น การประเมินสิ่งแวดล้อมระดับยุทธศาสตร์การประเมินผลกระทบต่อถิ่นที่อยู่อาศัยของสิ่งมีชีวิต ซึ่งควรนมาพิจารณาเพื่อปรับใช้กับการประเมินผลกระทบสิ่งแวดล้อมในโครงการผลิตไฟฟ้าจากพลังงานลมในประเทศไทยWind farms are promoted in many countries because they hope that it could reduce the emission of greenhouse gases from energy sectors. Although the generation of energy from wind turbines are zero carbon emission, the operation of the projects might cause the effect on environment and people such as unbearable noise and toxic chemicals released from the operation. Therefore, the environmental assessment would be the essential tool that could reduce the negative effects from such projects. This study shows that in case of Thailand, under the Enhancement and Conservation of the National Environmental Quality Act, (B.E.2535) 1992, any operators of wind farms is not required to carry out the environmental impact assessment; however, the assessment may be required to satisfy conditions stipulated by other laws. On the other hand, the Scottish operators shall comply with a Scottish law concerning the environmental impact assessment before launching wind farm projects. Moreover, this study shows some interesting environmental assessment patterns in Scotland such as Strategic Environmental Assessment, Habitats Regulations Appraisal which might be the guidance to develop the legal measures and environmental assessment system in Thailand. |
