Abstract | This research aims to examine the scope and principles of Section 20 of the Computer-Related Crime Act B.E. 2560 (2017), as well as to analyze its consistency with the rule of law and the right to freedom of expression. In addition, the study evaluates the effectiveness of state regulatory mechanisms in removing or suppressing digital content on online platforms. It also compares international regulatory approaches that emphasize strong protection of civil rights, with the objective of proposing legal reforms to better align with the principles of the rule of law. This study adopts a qualitative research methodology through legal document analysis, academic literature review, and case studies from both domestic and international sources. Content analysis is employed to assess the consistency of the law with the rule of law principles.findings reveal that Section 20 presents several challenges in relation to the rule of law, including the vague definition of "public morality," the absence of an effective appeals mechanism, and the potential misuse of state power that may undermine freedom of expression. Although judicial review plays a role in controlling state power, the lack of clear standards for such review remains a concern.This research concludes that revising Section 20 is essential not only for striking a balance between national security and the protection of individual rights, but also for enhancing the effectiveness of digital platform governance in Thailand in accordance with democratic principles. |
