Abstract | This research article has the following objectives: 1) to study and analyze the problems, obstacles, and factors affecting the effectiveness of mediation of criminal disputes at the investigation stage in Pathum Thani Province; and 2) to suggest guidelines for the development of mediation of criminal disputes at the investigation stage of police officers in Pathum Thani Province. This research is a qualitative research, collecting data through in-depth interviews with 19 key informants and focus group discussions with 12 people. The data types are analyzed and the reliability of the research results is checked using triangulation.The research results found that:1) Problems, obstacles and factors affecting the effectiveness of criminal mediation at the investigation stage in Pathum Thani Province Problems and obstacles are caused by the number of mediators being insufficient for the number of cases, budget constraints, the Royal Thai Police's mediator appointment process being delayed. Factors found were personnel factors in mediation, lack of knowledge, skills and continuous development of mediators, factors in the recipients of mediation services, readiness of the parties still limited in terms of access and understanding of the mediation process, factors in the criminal mediation process, limitations in the types of cases that can enter the mediation process are significant obstacles to resolving criminal disputes, including the amount of documents in the criminal mediation process and factors supporting mediation, budget, management and coordination between agencies, locations, materials and equipment.2) Suggestions for development of criminal mediation at the investigation stage by police officers in Pathum Thani Province found that in terms of personnel, the skills of mediators should be developed, legal knowledge should be developed, in terms of processes, the time frame should be set, it should be flexible and appropriate for the actual situation, in terms of supporting factors. The coordination system between agencies should be developed to be clearer and more efficient. The public relations system both inside and outside the organization should be systematically developed. In terms of location, materials and equipment, a specific area for mediation should be allocated in every police station, designed to provide privacy and create an atmosphere conducive to negotiation. |
